This website at potassiumfiber.com, and everything on it, is operated by Dr Brad Inc ("Dr Brad Inc", "we", "us", "our"), a company registered in the State of Delaware, United States, at 2810 N Church St, PMB 67699, Wilmington, DE 19802. Throughout the site the term "Services" means this website, the store, and all content, tools and products offered through it.
By visiting this site or buying something from it, you agree to these Terms of Service and to the policies linked from them, including our privacy policy, shipping information and returns and refunds policy. If you do not agree to them, do not use the Services.
1. Who may use the Services
You must be at least 18 years old, or the age of majority where you live, to buy from this store. By placing an order you confirm that you are. You agree not to use our products or the Services for any unlawful purpose, and not to break any law in your jurisdiction, including copyright law, by using them.
2. Our products
Our products are dietary supplements. They are not medicines. This site gives general information, not medical advice, and nothing on it is a substitute for advice from your own doctor. Our products are not for children. If you have a health condition, are pregnant or breastfeeding, or take prescription medication, speak to your doctor or pharmacist before use.
We try hard to represent our products accurately. Colors and packaging may look different on your screen depending on your device, and product descriptions, formulations and packaging can change. We do not warrant that a product's appearance will match what is shown here. We may discontinue a product at any time, and we may limit quantities per person, per region or per order.
Ingredient and nutrition information published before the first production run is described on this site as provisional where it is provisional. The Supplement Facts panel printed on the pouch you receive is the authoritative statement of what is in it.
3. Pre-sale orders
Some products on this site are sold in advance of manufacture. Where a product is offered as a pre-sale, the product page states the expected dispatch date and the number of units available.
Placing a pre-sale order means you are charged at checkout and your goods are dispatched on or after the stated date. If that date changes materially we will email you before it changes. You may cancel a pre-sale order for a full refund at any time before it is dispatched. If we are unable to supply your order at all, we will cancel it and refund you in full.
4. Orders and acceptance
An order you place is an offer to buy. We may accept or decline it, in whole or in part, for any reason. Your order is accepted only when we confirm acceptance, and we must have received and processed your payment first. If we decline, change or cancel an order, we will try to contact you using the email address or phone number you gave at checkout.
Please check your order before you submit it. Once an order has been accepted we may not be able to change or cancel it, other than as set out in section 3 and in our returns policy.
5. Prices, currency and billing
Prices are set in United States dollars. If you are shopping from another country, our store may display and charge a converted amount in your local currency using the exchange rate applied by our payment providers. The converted amount is shown to you before you pay.
Prices and shipping charges can change without notice. We are not obliged to honor a price that is obviously wrong, and we may correct errors, inaccuracies or omissions and cancel or change an affected order even after it has been submitted, including after your card has been charged. Where we do, we will refund you.
You agree to provide current, complete and accurate purchase and account information, and to update it so that we can complete your order and contact you.
Taxes are calculated and shown at checkout where they apply. Import duties, value added tax charged on arrival, and customs handling fees are set by the destination country, are not collected by us, and are the recipient's responsibility.
6. Shipping and delivery
Delivery times given anywhere on this site are estimates, not guarantees. Risk of loss and title pass to you when the goods are handed to the carrier, though as a matter of practice we will replace or refund a package that is lost or damaged in transit. Full detail is on the shipping page.
7. Returns and refunds
Our returns and refunds policy forms part of these Terms. Nothing in these Terms limits any consumer right you have under the law where you live, including the statutory rights to cancel that apply in the United Kingdom and the European Union.
8. Accuracy of information on this site
We publish nutrition and health information in good faith, with sources cited so you can check them. It is general information, it is not tailored to you, and it may become out of date. We are not liable for decisions you make on the basis of it. Where we cite research we try to describe its limitations; where we cannot verify something, we leave it out.
We are not responsible if information on this site is not accurate, complete or current. Any reliance you place on it is at your own risk.
9. Accounts and account security
If you create an account, you are responsible for keeping your login details confidential and for everything that happens under your account. Tell us promptly if you think someone else has gained access to it. We may suspend or terminate an account, or refuse service, at our discretion.
10. Your content and feedback
If you send us ideas, suggestions, reviews or other material, whether at our request or not, you agree that we may use, copy, edit, publish and distribute it, in any medium, without restriction and without any obligation to pay you or credit you. You are responsible for the content you send, and you agree that it will not be unlawful, abusive, deceptive or infringe anyone's rights. We may, but are not obliged to, monitor, edit or remove content.
11. Intellectual property
The content on this site, including text, product formulations as described, photographs, graphics, logos and the compilation of all of it, belongs to Dr Brad Inc or its licensors and is protected by intellectual property law. You may view it and print or download copies for your own personal, non-commercial use. You may not republish, sell, or use it commercially, or use our name or logo, without our written permission.
12. Third party links and services
This site may link to, or make available, material and services from third parties. We do not control them, we do not endorse them, and we are not responsible for their content, accuracy or for any harm or loss connected with them. Read the third party's own terms before you deal with them.
13. Shopify
This store is hosted on Shopify Inc., which provides the online platform that lets us sell our products to you.
14. Prohibited uses
You may not use this site or its content for any unlawful purpose; to solicit anyone else to do anything unlawful; to infringe any intellectual property right; to harass, abuse, defame or discriminate; to submit false or misleading information; to upload malicious code; to collect or track other people's personal information; to spam, phish, scrape or crawl in a way that burdens the site; or to interfere with the security features of the Services. We may terminate your use of the Services for breaking any of these.
15. Automated agents
If you use an automated agent, assistant or other software to browse or buy on your behalf, you remain responsible for everything it does in your name, including the orders it places and the information it provides. We may block automated access that degrades the site for other people.
16. Disclaimer of warranties
Except where we have expressly stated otherwise, the Services and all products offered through them are provided "as is" and "as available", without any representation, warranty or condition of any kind, whether express or implied, including any implied warranty of merchantability, merchantable quality, fitness for a particular purpose, durability, title or non-infringement. We do not guarantee that your use of the Services will be uninterrupted, timely, secure or error free, or that any result obtained from them will be accurate or reliable. Some jurisdictions do not allow these disclaimers, so parts of this section may not apply to you.
17. Limitation of liability
To the fullest extent permitted by law, Dr Brad Inc, its directors, officers, employees, affiliates, agents, contractors, suppliers and service providers, and those of Shopify, will not be liable for any injury, loss or claim, or for any direct, indirect, incidental, punitive, special or consequential damages of any kind, including lost profits, lost revenue, lost savings, loss of data or replacement costs, whether based in contract, tort including negligence, strict liability or otherwise, arising from your use of the Services or of any product bought through them, even if we have been advised that such damages are possible. Where a jurisdiction does not allow the exclusion or limitation of liability for consequential or incidental damages, our liability is limited to the maximum extent permitted by that law.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be excluded or limited. Consumers in the United Kingdom, the European Union and Australia have rights under national consumer law that these Terms do not affect.
18. Indemnity
You agree to indemnify and hold harmless Dr Brad Inc and Shopify, and our respective affiliates, officers, directors, employees, agents, contractors, licensors and service providers, from any claim or demand made by a third party, including reasonable legal fees, arising out of your breach of these Terms or of any law, or your infringement of a third party's rights.
19. Severability
If any part of these Terms is found to be unlawful or unenforceable, that part is severed to the minimum extent necessary and the rest of the Terms continue in force.
20. Termination
These Terms are effective unless and until terminated by you or by us. You may terminate them by ceasing to use the Services. We may terminate them at any time, without notice, if we believe you have breached them, and you will remain liable for all amounts owed up to that date.
21. Entire agreement and waiver
Our failure to enforce any part of these Terms is not a waiver of that provision. These Terms, together with the policies posted on this site, are the entire agreement between you and us about your use of the Services, and replace any earlier agreements or communications. Any ambiguity is not to be construed against the drafting party.
22. Assignment
You may not assign or transfer your rights under these Terms. We may assign ours, for example as part of a merger or sale of the business, without restriction.
23. Governing law and jurisdiction
These Terms, and any separate agreement under which we provide Services to you, are governed by the laws of the State of Delaware, United States, without regard to its conflict of law principles. You and Dr Brad Inc agree to the venue and personal jurisdiction of the state and federal courts located in Delaware.
If you are a consumer resident in the United Kingdom, the European Union or Australia, this clause does not deprive you of the protection of the mandatory consumer law of your country of residence, or of your right to bring proceedings in your local courts where that law gives you that right.

Headings are for convenience and do not affect the meaning of these Terms.
25. Changes to these Terms
The current version of these Terms is always on this page, with the date it was last updated at the top. We may update them by posting a new version here. We will tell you about material changes where the law requires it, and continuing to use the Services after a change means you accept it.
